Terms and Conditions for Product Customization

Welcome to The Olf Candles. These Terms and Conditions (“Terms”) govern the use of our product customization services available at https://www.theolfcandles.in. By placing a customization order, you agree to be bound by these Terms.
1. DEFINITIONS
1.1. “Customization” and “Personalization”: These terms are used interchangeably and refer to the process of modifying specific attributes of a product as specified in a customization order.
1.2. “User”: Refers to any individual or entity placing a customization order with The Olf Candles.
1.3. “Materials”: Refers to any text, design, image, or other content provided by the user for the purpose of customization.

2. ASSENT & ACCEPTANCE
2.1. By placing a customization order, you affirm that you have read, understood, and agree to these Terms without limitation or qualification.
2.2. If you do not agree to these Terms, you may not use our customization services.
3. TERMS OF CUSTOMIZATION
3.1. Scope of Customization: Only the specified section of the candle, as described in the customization order, will be customized. Any additional modifications must be agreed upon in writing.
3.2. Restrictions: We reserve the right to reject any customization requests that include nude, vulgar, profane, or otherwise inappropriate text, designs, or images.
3.3. User Permissions and Responsibility:
- The user warrants that they have sufficient permissions to use the Materials provided for customization.
- The user accepts full responsibility for any copyright or intellectual property claims arising from the use of such Materials.
- By providing Materials, the user grants us the right to store and use them solely for fulfilling the customization order. The user waives any claims against us related to the use of these Materials.
3.4. No Guarantees: We do not provide guarantees or warranties regarding the color of the jar, wax, label, packaging, or any other aspect of the customized product. Variations may occur due to production processes.
4. PAYMENT & CANCELLATION
4.1. Prepaid Orders: All customized product orders are prepaid. Orders will not be processed until full payment is received.
4.2. Cancellations and Refunds:
- No refunds will be issued if a customization order is cancelled.
- Customized products are non-returnable and non-refundable, except in cases where the wrong product is delivered or the customization does not match the user’s order specifications.
5. LIABILITY
5.1. Data Breach: While we take reasonable measures to protect user-provided Materials, we shall not be held responsible for any data breaches, leaks, or thefts of such Materials.
5.2. Incorrect Customization: If an error in customization occurs due to our fault, we will rectify the issue by remaking or replacing the product at no additional cost.
5.3. Wrong Product Delivery: In the event of delivering a wrong product, we will arrange for a replacement at no additional cost.
6. FORCE MAJEURE
6.1. We shall not be held liable for any failure or delay in fulfilling customization orders due to circumstances beyond our reasonable control, including but not limited to acts of God, natural disasters, governmental actions, strikes, or interruptions in supply chains.
7. GENERAL PROVISIONS
7.1. Governing Law: These Terms shall be governed by and construed in accordance with the laws of Kolkata, India.
7.2. Amendments: We reserve the right to amend these Terms at any time. The updated Terms will be effective upon posting on our Website.
7.3. Entire Agreement: These Terms constitute the entire agreement between the user and The Olf Candles concerning customization services.
7.4. Severability: If any provision of these Terms is deemed invalid or unenforceable, the remaining provisions shall remain in full force and effect.
